General Terms and Conditions for the Ski Challenge ’15 
Ski Challenge ’15 is a virtual 3D simulation for PC and MAC, in which skiing races can be contested both offline and online.
Multiple qualification and competition modes are offered during the course of Ski Challenge ’15. 

I PARTICIPATION AND COMPETITION  

1. A requirement for participating in the competition of Ski Challenge ’15 and all activities associated with it is registering
for the competition modes with a valid email address as well as the truthful, correct and complete specification of one’s personal data (user account).
The user is responsible for the accuracy and completeness of the personal data and the email and/or postal address that they specify.
Registration permits the use of Ski Challenge ’15 with all offered terminals under the same user account. 

2. Participation is free of charge. Employees of Greentube Internet Entertainment Solutions GmbH and its subsidiaries and persons involved in developing
Ski Challenge ’15 and their relatives are excluded from participating in competitions. All use for commercial purposes (including self-promotion),
in particular but not restricted to sublicensing, reselling and/or loaning, is forbidden. 

3. In the period from 25 November 2014 to 31 March 2015 (the ‘season’), the times of all the users registered within Ski Challenge ’15 are to be entered in the rankings.
Registered users may participate in several competitions. If two users get the same time, the participant whose best time was first entered in the rankings wins. 

4. By registering, the registered participants of Ski Challenge ’15 expressly consent to Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH,
as well as Ski Challenge ’15 cooperation partners, using and exploiting the personal data they provided during registration for running the competitions and for their own marketing purposes.
This declaration of consent may be revoked by email at any time. 

5. Furthermore, when participating in Ski Challenge ’15 non-personal usage data (e.g. hardware information, game statistics, ad impressions) that the participant does not actively provide
is constantly processed and stored in order to prevent possible faults and misuse and to enable the adaptation and further development of Ski Challenge ’15.
In the event of misuse, the right to pass on this data to law enforcement authorities is reserved.
Any usage or dissemination of this usage data that goes beyond the above shall only occur with the participant’s explicit declaration of consent. 

6. Running the competitions and selecting the prizes is incumbent upon Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH and
their cooperation partners. 

7. The terms of delivery for supplying the prizes are to be defined by Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH and
their cooperation partners. The cost of delivery is to be covered by Funstage Spielewebseiten Betriebsges.m.b.H. Funstage Spielewebseiten Betriebsges.m.b.H. is authorised
to transmit the winner’s data to its cooperation partners in order to enable the delivery of prizes. 

8. The winners of the PC/MAC version are to be notified of this by Funstage Spielewebseiten Betriebsges.m.b.H by email,
and the winners where appropriate shall be published on the website under their player names.
A requirement for participating in the competitions is having your main residence in the EU, Switzerland or Norway. 

9. If a winner does not respond to the email notification within two weeks of the send date,
their claim to the prize is waived and Funstage Spielewebseiten Betriebsges.m.b.H can decide whether the prize is to be awarded to another winner or used for charitable purposes. 

10. Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH reserve the right to alter and/or deny winnings and positions in the rankings
if these were achieved through the incorrect specification of personal data, or the multiple registration of one person under different player names, or attempts to influence
the outcomes of games by interfering in the program, disruptions or other actions against the rules, or influencing the course of play by deliberately causing malfunctions or disruptions. 

11. Furthermore, Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH reserve the right to alter and/or deny winnings and positions in the rankings if the results of a game were achieved by a user breaking the rules. This also applies if this breach of rules is technically possible without the user having to possess special knowledge, abilities or technical requirements to do this. Such changes and/or refusals may also affect the winnings and positions in the rankings of other users. 

12. Furthermore, Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH reserve the right to award just one prize per person and per season. It is not possible to receive a cash payment or exchange a prize. There is no legal right of appeal to this. No liability is assumed for legal or material defects of prizes. 

13. Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH do not assume liability in any way for any kind of damage, especially for such damage that may occur as a result of errors, delays or interruptions to the transmission of data, during faults with technical equipment and the service, incorrect content, the loss or deletion of data, viruses, or in any other way as part of participating in the competitions. No claims can be lodged against Funstage Spielewebseiten Betriebsges.m.b.H or against Greentube Internet Entertainment Solutions GmbH for disruptions during a skiing race, irrespective of which game mode is being played. 

14. Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH have the right to publish images and videos of the user’s races (or parts thereof) and the results on the Internet and to report on this in any conceivable fashion through the media channels of Funstage Spielewebseiten Betriebsges.m.b.H and all the other cooperating partners of Greentube Internet Entertainment Solutions GmbH while providing the player’s name. The user expressly consents to this reporting and hereby grants to Funstage Spielewebseiten Betriebsges.m.b.H and Greentube Internet Entertainment Solutions GmbH all the usage rights required for the reporting mentioned irrevocably, exclusively, free of charge, and without material, temporal or geographical restriction.  

II. LICENCE AGREEMENT 

1. This Licence Agreement for the software product Ski Challenge 15 shall be concluded between you (as a natural person or corporate body, hereinafter referred to as the ‘Licensee’) and the Operator when you install, duplicate or use the software. 

2. The Licensee shall only use the software for private purposes. Any use of the software for commercial purposes (including self-marketing) – especially, but not limited to, sub-licensing, reselling and/or renting out – is prohibited.  

III. MISCELLANEOUS PROVISIONS 

1. After registering, you can find the current version of these General Terms and Conditions when you click on the “§” button in the info menu. The user undertakes to remain informed about the current version of these General Terms and Conditions. As soon as a new version of these General Terms and Conditions is published, the user accepts the new version by using the service. If the user objects to the new version, the App must be uninstalled. 

2. All announcements and statements concerning this legal relationship shall only be valid if released in the Software. 

3. By using the Software, every user acknowledges the exclusive (intellectual) property rights of the Operator to these General Terms and Conditions. 

4. If any of the provisions or conditions of this Agreement should be legally ineffective, this shall not affect the rest of this Agreement. This shall not apply if, in such an event, adherence to the Agreement would represent an unreasonable hardship for one party to the Agreement.
